Accident Compensation legislation is complex and you can be certain that the ACC staff member you are dealing with has no practical knowledge of it. ACC staff are trained in ACC policy not ACC legislation and it is legislation that comes out on top if argued correctly.

There are also several protections in the legislation for claimants but they are mostly preventative in application and if not applied at the correct stage of the process the processes are bypassed.

The Accident Compensation Act 2001 (AC Act 2001) is essentially a state insurance scheme and can be broken down to two basic considerations. Cover and entitlement. Cover determines if a claimant has access to the scheme and if so what entitlements the claimant is entitled to under law.
